EVENT, DOCK, RANCH AND WATERFRONT WAIVER OF
LIABILITY, ASSUMPTION OF RISK, AND RELEASE AGREEMENT
This Waiver of Liability and Assumption of Risk Agreement (“AGREEMENT”) is entered into by the Individual or 2nd Saturdays Attendee (“GUEST”), in connection with their voluntary access to and use of the Property owned by Brennan Family Dock LLC, 2nd Saturdays LLC, Brennan Family Trust &/or Lyle E Brennan &/or Connie Brennan &/or Ryan Brennan &/or related persons &/or Brennan Family related companies (“OWNER”) and located at 230 Private Road 1534, Bridgeport, TX, 76426 (“PROPERTY”), which includes but is not limited to a private dock, dock catwalk, lake access, open ranch land, and exposure to wildlife and livestock.
1. ACKNOWLEDGMENT OF INHERENT RISKS
GUEST agrees and acknowledges that entry upon and use of PROPERTY involves inherent risks including, but not limited to:
Slipping, tripping, or falling from or around the dock or dock catwalk, including but not limited to uneven surfaces, near water or wet surfaces;
Drowning or water-related or dock-related injuries associated with lake use, including but not limited to swimming, boating, or fishing;
Encounters with wild animals, insects, reptiles, or other natural hazards;
Risks associated with livestock including cattle, which may be unpredictable and potentially dangerous; and
Uneven terrain, open fencing, barbed wire, construction activities and natural environmental conditions found on ranch properties.
The GUEST understands, acknowledges and voluntarily agrees to assume all risks associated with GUEST’s use and presence on the PROPERTY; furthermore, GUEST agrees that they are solely responsible for their own safety and shall indemnify the OWNERS for the same.
2. RELEASE AND WAIVER OF LIABILITY
To the fullest extent allowed by law, GUEST, for themselves, their heirs, representatives, assigns, and next of kin, hereby waive, release, and discharge the OWNER, their agents, family members, employees, other guests or individuals, and representatives from any and all liability, claims, causes of action, or demands of any kind arising from or related to access to or use of the dock, lake, ranch, wildlife areas, or any other part of the PROPERTY, including claims arising from OWNER’s alleged negligence.
3. NO LIFEGUARD OR SUPERVISION PROVIDED, AGE RESTRICTIONS AND OWNER AUTHORITY
GUEST agrees and acknowledges that there is no lifeguard on duty, no security supervision or other supervision of any kind, and that all use of the PROPERTY is strictly at the GUEST’S own risk. GUEST ACKNOWLEDGES THE SECOND SATURDAY EVENTS ARE FOR ADULTS ONLY (18 YEARS OR OLDER); AND THAT NO GUEST UNDER THE AGE OF 21 WILL DRINK ANY ALCOHOLIC BEVERAGE. NOTWITHSTANDING ANYTHING CONTAINED HEREIN, FOR ANY REASON THE OWNER MAY REQUIRE A GUEST TO ADHERE TO OWNERS’ PROPERTY USE RULES OR TO IMMEDIATELY VACATE THE PROPERTY, THE GUEST ACKNOWLEDGES AND AGREES THAT THEY WILL SUBMIT TO THE OWNERS’ RULES, AND IF ASKED BY OWNER TO LEAVE THE PROPERTY, GUEST WILL IMMEDIATELY AND PEACEABLY VACATE THE PROPERTY.
4. WILDLIFE AND LIVESTOCK NOTICE
The GUEST understands, agrees and acknowledges that wildlife, including snakes, deer, wild hogs, coyotes, bobcats and other potentially dangerous animals and insects may be present on the PROPERTY. GUEST also understands, agrees and acknowledges that cattle or other livestock may roam freely on the PROPERTY. The GUEST agrees to maintain a safe distance and not to approach, harass, feed, or interact with any animals. The GUEST understands, agrees and acknowledges OWNER is not responsible for injuries caused by wildlife or livestock.
5. ACCIDENTS, INJURIES OR DEATH
The GUEST understands, agrees and acknowledges OWNER is not responsible for any accidents, injuries or death of any kind or any caused by other guests. The GUEST additionally agrees to waive all rights for any and all claims against OWNER and other guests.
6. NO PETS ALLOWED
The GUEST agrees that no pets of any kind shall be brought on PROPERTY. This is to protect livestock, wildlife, and the safety of OWNER and all guests. Any violation of this rule may result in immediate termination of access to the PROPERTY for the GUEST and liability for any damage caused by the GUEST.
7. INDEMNIFICATION
The GUEST agrees to indemnify and hold harmless the OWNER and other guests from all losses, liabilities, claims, damages, or expenses, including attorney fees, arising out of or related to GUEST’s presence on or use of the PROPERTY.
8. NO WARRANTIES OR GUARANTEES
The PROPERTY is made available in “AS IS, WHERE IS WITH ANY AND ALL FAULTS” condition. The OWNER makes no representations or warranties regarding the safety, maintenance, or condition of the PROPERTY, including but not limited to, any structures, trails, docks, bodies of water, livestock, wildlife, or features of the land.
9. GOVERNING LAW
This AGREEMENT shall be governed by and interpreted in accordance with the laws of the State of Texas. Any legal action arising under this AGREEMENT shall be brought in the appropriate court within that state.
10. ACKNOWLEDGMENT AND VOLUNTARY ACCEPTANCE
By accessing or using the PROPERTY, the GUEST affirms that they have read, understood, and voluntarily agreed to the terms and conditions set forth in this AGREEMENT, and accept all risks associated with such use.
BY SIGNING BELOW, I, GUEST, ACKNOWLEDGE THAT I HAVE READ, UNDERSTOOD, AND VOLUNTARILY AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT.
